5. Estimates and Pricing

Project pricing depends on the scope of work, materials selected, layout changes, site conditions, product availability, labor requirements, permits, installation needs, customization level, and other project-specific factors.

Any estimate provided is for planning purposes until confirmed in a written proposal or signed Home Improvement Contract.

6. Discounts and Promotions

Special discounts, offers, or promotions may be available from time to time. All discounts are subject to availability, project eligibility, company approval, and written confirmation. Discounts cannot be guaranteed unless included in an official written proposal or agreement from Elegant Kitchen Cabinets.

7. Project Scope and Written Agreements

All remodeling, cabinetry, countertop, appliance, storage, and construction-related work must be reviewed and approved through a written agreement before any project begins.

Final pricing, timelines, materials, products, responsibilities, and payment terms will be detailed in the official project proposal or contract.

8. Home Improvement Contracts

All home improvement work performed by Elegant Kitchen Cabinets is governed by a separate written Home Improvement Contract that complies with California Business & Professions Code §7159.

The website, estimates, design consultations, and any informal communications do not create a binding home improvement contract. Before any work begins, you will receive a written contract that includes the full scope of work, materials, total price, payment schedule, project timeline, and all consumer protections required by California law, including the three-day right to cancel under California Civil Code §1689.6.

9. Designs, Renderings, and Measurements

Design concepts, drawings, renderings, layouts, and measurements are provided to help clients visualize their project. Final designs, dimensions, materials, and installation details may change based on field measurements, product specifications, site conditions, client selections, and technical requirements.

10. Product Availability

Cabinetry, countertops, appliances, hardware, accessories, finishes, colors, and other products may be subject to manufacturer availability, lead times, discontinued items, shipping delays, or specification changes.

Elegant Kitchen Cabinets will make reasonable efforts to communicate available options and alternatives when needed.

11. Images and Portfolio

Images shown on this website may include completed projects, showroom displays, design inspiration, product examples, manufacturer photography, or partner brand references.

Elegant Kitchen Cabinets shall not be liable for any delay or failure to perform any obligation under these Terms or any related agreement when such delay or failure is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, earthquakes, fires, floods, severe weather, pandemics, public health emergencies, government actions or orders, permit or inspection delays, regulatory changes, supply chain disruptions, manufacturer delays, material shortages, transportation delays, labor disputes, strikes, contractor or subcontractor unavailability, utility outages, internet or telecommunications failures, war, terrorism, civil unrest, and any other event of force majeure.

22. Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to them, the website, or any services provided by Elegant Kitchen Cabinets shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and the parties consent to the personal jurisdiction and venue of those courts.

23. Dispute Resolution

Before initiating any legal action, you agree to first contact Elegant Kitchen Cabinets in writing at the address listed below to attempt to resolve the dispute informally.

If the dispute is not resolved within thirty (30) days after written notice, either party may proceed in accordance with the Governing Law and Jurisdiction section. Nothing in this section limits either party’s right to seek relief in small claims court for qualifying disputes.

24. Contractor Licensing

Elegant Kitchen Cabinets operates under California Contractor License #1145191, held by Elegant Closets Construction Inc. The company is bonded and insured as required by California law.

As required by the California Contractors State License Board:

Contractors are required by law to be licensed and regulated by the Contractors State License Board, which has jurisdiction to investigate complaints against contractors if a complaint is filed within four years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors State License Board, P.O. Box 26000, Sacramento, CA 95826, or by visiting www.cslb.ca.gov.

25. Mechanic’s Lien Notice Reference

Under California law, contractors, subcontractors, laborers, and material suppliers who provide services or materials for the improvement of your property may have the right to record a mechanic’s lien against your property if they are not paid.

The full Mechanic’s Lien Warning required by California Civil Code §8200 through §8216 will be provided in your written Home Improvement Contract before any work begins.

26. Down Payment and Progress Payments

In compliance with California Business & Professions Code §7159.5, the down payment for any home improvement project will not exceed one thousand dollars ($1,000) or ten percent (10%) of the contract price, whichever is less.

Subsequent progress payments will not exceed the value of work performed or material delivered. Any design retainer or pre-payment will be clearly disclosed in your written agreement.

27. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

28. Entire Agreement

These Terms, together with our Privacy Policy and any signed written agreements between you and Elegant Kitchen Cabinets, constitute the entire agreement between you and Elegant Kitchen Cabinets regarding the website and supersede all prior agreements, communications, and understandings, whether written or oral, on the subject.

29. Assignment

Elegant Kitchen Cabinets and Elegant Closets Construction Inc. may assign or transfer their rights and obligations under these Terms, in whole or in part, at any time without notice, including in connection with a merger, acquisition, sale of assets, reorganization, or other business transaction.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We reserve the right, in our sole discretion, to suspend, restrict, or terminate your access to the website at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

Upon termination, all provisions of these Terms that by their nature should survive termination shall remain in effect, including provisions regarding intellectual property, indemnification, limitation of liability, disclaimer of warranties, dispute resolution, and governing law.

The failure of Elegant Kitchen Cabinets to enforce any provision of these Terms shall not be deemed a waiver of that provision or of any other provision.

No waiver of any right under these Terms shall be effective unless made in writing and signed by an authorized representative of Elegant Kitchen Cabinets.

Elegant Kitchen Cabinets may update these Terms at any time. Updates will be posted on this page with an updated “Last Updated” date. Continued use of the website after such changes constitutes your acceptance of the updated Terms.
